Michigan Legal Climate Under Fire – Personal Injury Attorneys Aiming to Sue All Regulated Businesses and Professions – Voice Your Opposition Today!

Legislation is under consideration in the Michigan House of Representatives to create new opportunities for personal injury attorneys to file costly consumer protection lawsuits against over 80 different businesses, trades and professions already regulated by, and subject to penalties and litigation under, various state and federal laws. Voice your opposition today!

Under current law, companies and individuals regulated by state and federal laws must comply with a wide range of requirements and are subject to regulatory oversight, lawsuits and penalties under their regulatory statute(s) for a wide range of wrongdoings. House Bill 4915, introduced by Rep. Robert Jones (D-Kalamazoo), ignores these existing penalties and remedies and seeks to subject Michigan employers to parallel tracks of litigation, including class action lawsuits, under the Michigan Consumer Protection Act.  

HB 4915 would wreak havoc on small and large businesses alike, impacting nearly every industry and profession regulated under state and federal law, including (but not limited to) real estate agents, casinos, national banks, finance companies, land surveyors, medical device retailers, physician assistants, pharmacists, nursing homes, dentists, chiropractors, accountants, personnel agencies, employment agencies, consultants, engineers, builders, car dealers and dealerships, investment brokers and advisors, finance companies, airlines, pharmaceutical companies, doctors, hospitals, veterinarians, funeral homes, plumbers, architects, telecommunication companies, insurance agents, psychologists, barbers and insurers (for activities not covered under Chapter 20 of the Insurance Code). 

If enacted, HB 4915 would make Michigan’s Consumer Protection law an attractive means for innovative and profit-motivated personal injury attorneys to attack a wide range of conduct already regulated and promote their own regulatory agenda.
